The company and its partner companies may file a supplemental response to the FDA’s request with the agency within two weeks after the date of final submission. If the company does not file a supplemental response, the FDA may ask the FDA to approve the request with the new law or the FD& C Act.
The FDA’s decision will be determined by this court’s decision on the second supplemental response. The court will also consider the other factors listed in paragraph (b) of this paragraph that are relevant here.
